New Immigration Regulations - The First 100 Days

The new Immigration Regulations have been promulgated on July 1^st 2005 but already today severe and unforeseeable difficulties are experienced in their application.

A change regarding the organisation structure of the Department of Home Affairs is in the meantime affecting applicants for Permanent Residence. In future all these application will be centrally processed in Pretoria. This internal decision has created a enormous workload for the authority and may cause further delays for applications that were handed in more than twelve month ago and are being processed ever since.

The most serious consequences are experienced by applicants for Work Permits. As we have informed you in one of our earlier editions and as you may read up on www.ibn.co.za , the same four categories were upheld under the new legislation. In the past a great number of applicants would qualify for Quota Work Permits, applicable for employees with certain backgrounds, which had to be documented by proving special qualifications and relevant experience. The Quota Work Permit is still mentioned in the new legislation; however it is now linked to occupational categories. As no occupational categories have been published by the Department of Home Affairs so far, it refuses categorically to accept any submissions in this respect. As a consequence, the applicants are requested to apply for a General Work Permit, with a vast number of bureaucratic hurdles to be taken by the applicant. The possibility to work in South Africa obviously still exists as it has, however, the preparation time has increased and we therefore advise to plan in at least three months to prepare work permits.

According to information, yet to be confirmed the Department of Home Affairs intends to publish the categories for Quota Work Permits within the following months. We will keep you up-dated!

100 Tage neue Immigrationsrichtlinien - ein Bericht aus der Praxis

Erst am 1. Juli 2005 sind die neuen Immigrationsrichtlinien in Kraft getreten, doch bereits haben sich Probleme bei dessen Anwendungen gezeigt, die nur schwer als Kinderkrankheiten beschrieben werden können.

Eine interne Entscheidung zieht weite Kreise für Antragssteller auf eine Daueraufenthaltserlaubnis, die Permanent Residence. Solche Anträge werden in Zukunft zentral in Pretoria bearbeitet. Die Arbeitsbelastung, die auf den Schultern dieser einzelnen Behörde lastet, ist bereits immens, so dass eine weitere Verzögerung der Finalisierung von Anträgen, die schon seit zwölf oder mehr Monaten in Bearbeitung sind zu befürchten ist.

Am schwersten wiegt jedoch die Behandlung von Anträgen auf eine Arbeitserlaubnis. Wie bereits früher dargestellt und auf unserer Homepage www.ibn.co.za nachzulesen, existieren weiterhin vier Antragsarten auf Erteilung der Arbeitserlaubnis. In der Vergangenheit qualifizierten sich zahlreiche Antragssteller für die Quota Work Permit, die für Arbeitnehmer mit bestimmten beruflichem Hintergrund einschlägig war und bei Vorliegen entsprechender Qualifikationen und einschlägiger Berufserfahrung ohne wesentliche weitere Nachweise erteilt wurde. Die Quota Work Permit ist weiter im Gesetz verankert, ihre Erlangung ist nun jedoch bestimmten Berufsgruppen vorenthalten. Derzeit weigert sich das Department of Home Affairs jedoch kategorisch, darauf gerichtete Anträge anzuerkennen. Der Grund ist, dass die Behörde bisher keine Berufsgruppen veröffentlicht hat, auf die sich die Quoten beziehen. Diese interne Versäumnis wird zum Anlass genommen sämtliche Antragssteller auf die General Work Permit zu verweisen. Der Weg in die Arbeitstätigkeit in Südafrika ist nichtsdestotrotz  weiterhin möglich wie zuvor, jedoch ist der Aufwand und Zeitaufwand nun um einiges höher als bisher. Wir empfehlen daher mindestens drei Monate für die Vorbereitung einer Arbeitserlaubnis einzuplanen.

Noch zu bestätigenden Angaben zu Folgen steht die Veröffentlichung der Quoten in den nächsten Monaten bevor. Wir halten Sie auf dem Laufenden!

Claims by Wheels24 that taxes are to blame for high car prices have been borne out by a new independent study carried out by B&M Analysts.

Wheels24 has consistently alleged that high taxes - many of them hidden - are to blame for our out-of-kilter vehicle pricing, not manufacturer collusion or the Motor Industry Development Program (MIDP), as claimed by the Government's Competitions Commission - without any subsequent evidence. "Taxes account for 34% of the price of more expensive vehicles in South Africa, and there is a 17% differential in the price of cars in this category compared with the UK simply on the basis of the tax burden," said Dr Justin Barnes, the managing director of B&M Analysts and a co-author of the report.

The report was written in conjunction with Raphael Kaplinsky, a professor at the University of Sussex in the UK, and Mike Morris, a professor at the University of KwaZulu-Natal. Barnes said the independent study compared the price of vehicles in South Africa and the UK but without all the taxes and built-in "free" maintenance programs which apply in South Africa.

Maintenance

In Europe maintenance programs are usually an extra-cost option.

South African taxes include the sliding scale excise duty, which gets as high as 20% on vehicles costing more than about R400 000, and 14% VAT in South Africa compared with 17.5% VAT in the UK. "The perception is that vehicles are more expensive in South Africa than overseas, but this is a complete fallacy," said Barnes. "Our study bears this out. Vehicle prices in South Africa (minus taxes and maintenance programs) are between 5% cheaper and 5% more expensive than the UK."

Affordability was another issue, and Barnes said there was an argument that South Africans earned a lot less than people in the UK, which affected vehicle affordability while interest rates were also higher than in developed countries. He said this meant South Africans used a greater portion of their disposable income on vehicles than people overseas. "The perception is that big multinationals are ripping people off, the evidence we have got is that that is not the case ... luxury cars are more expensive because of the massive tax burden," he said further.

Fahrzeugpreise

B&M Analysts hat eine neue unabhängige Studie herausgebracht, welche die Beschwerde von Wheels24 bestätigt, dass die Steuern an den hohen Fahrzeugpreisen in Südafrika Schuld sind.

Wheels24 beharrt darauf, dass die hohen Steuern, viele davon versteckt, der Grund für die unverhältnismäßig hohen Fahrzeugpreise sind. Die Regierung behauptet dagegen, ohne jeglichen Beweis, dass die geheimen Absprachen der Autohersteller bzw. das Motor Industry Development Program (MIDP) der Grund dafür ist. Dr. Justin Barnes, Geschäftsführer der B&M Analysts und Co-Autor der Studie, sagt „Die Steuer in Höhe von 34%, welche auf teuere Autos erhoben wird, ist eine große Last für Südafrika. Verglichen dazu werden in Grossbritanien 17% weniger auf gleichwertige Fahrzeuge erhoben.“

Inspektion

Die in Europa vorhandenen Inspektionen sind normalerweise mit zusätzlichen Kosten verbunden.

Unter den südafrikanischen Steuern gib es die so genannte “sliding scale excise duty“. Diese Steuer steigt mit dem Preis des Fahrzeugs stetig an. Sie kann bei Autos in der Preisklasse um die R 400.000 bis zu 20% betragen. Dazu kommt die Umsatzsteuer in Höhe von 14%. Verglichen dazu fällt in Grossbritanien lediglich eine Umsatzsteuer in Höhe von 17.5 % an.“ Die Wahrnehmung, dass Fahrzeuge in Südafrika teurer sind als in Übersee, ist ein völliger Trugschluss“ sagte Barnes. „Dies hat unsere Studie ergeben.“ Fahrzeugpreise in Südafrika (abzüglich der Steuern und Inspektionen) sind um ca. 5% günstiger als in Grossbritanien.

Die Erschwinglichkeit war ein weiterer Teil der Studie. Barnes fügt hinzu, dass Südafrikaner viel weniger verdienen als Briten, wodurch die Finanzierbarkeit genauso beeinflusst wird, wie die höheren Zinssätze, die es im Vergleich zu entwickelten Ländern gibt. Das bedeutet, dass Südafrikaner für ihre Fahrzeuge einen höheren Teil ihres verfügbaren Einkommens aufwenden müssen als in Übersee. „Wir haben den Beweis, dass es nicht der Tatsache entspricht, dass die Multinationalen die Bürger ausnehmen, sondern dass hochwertige Fahrzeuge tatsächlich teurer sind aufgrund der hohen Steuerlast.“

On Sunday 18th September on the occasion of the election to the German Bundestag, the election party at the Sea Point High School took place as planned.

With German Bratwurst, Crepes, cake and refreshments approximately 400 guests watched the live footage from the German TV and could assess the latest results. The party organized by Sea Point Gardens Restaurant and Bar, Cape Studies Language School and IBN was a perfect place for networking within the German Community at the Cape.

Wahlparty zur Bundestagswahl

Wie geplant fand am Sonntag, den 18. September in der Sea Point High School die Wahlparty anlässlich der Bundestagswahl statt. Bei frischer Rostbratwurst, Crepes, Backwaren und Erfrischungsgetränken, konnten die ca. 400 Teilnehmer die Live-Übertragung aus Deutschland sehen und den Wahlausgang begutachten.

Die von Sea Point Gardens Restaurant and Bar, Cape Studies Language School und IBN organisierte Party war ein ausgezeichneter Ort zum Knüpfen von neuen Kontakten innerhalb der Deutschen Gemeinde am Kap und eine gute Gelegenheit schon bestehende wieder aufzufrischen.

John Platter: Five Star Wines for 2006 / “Fünf Sterne Weine” für 2006

John Platter Five Star Wines 2006 announced

The announcement is the culmination of several months of intensive tasting by an internationally experienced team of some 5 000 individual wines.

These were sampled and ranked according to the guide's five-point scale, which ranges from 0 stars ('Somewhat less than ordinary') up to 5 stars ('Superlative. A Cape classic').

In the course of this year's evaluations, the guide's tasters identified 72 candidate five stars across a variety of categories - reds and whites, botrytised desserts and Natural Sweets, ports as well as methóde cap classique sparkling. As previously, only finished, bottled wines, available during the currency of the guide, were considered. The short-listed wines were then judged by a full panel. Andrew McDowall, the guide's publisher, says: 'Our policy remains to taste and assess, as far as is practically possible, all of the wines that are available for the duration of the particular edition, locally as well as abroad. Given the enormous number of ranges and individual products tasted, the wines which merit a five-star rating make up a very select group indeed.’

Bekanntgabe der 2006 John Platter “Fünf Sterne Weine”

Die Bekanntgabe der 2006 „Fünf Sterne Weine“ ist das Resultat von intensiven Verkostungen welchen eine internationales Expertenteam über mehrere Monate durchführte und ungefähr 5000 verschiedene Weine zur Probe hatte.

Die Weine wurden nach einer 5-Punkte-Skala eingestuft, wobei die 0 das schlechteste und die 5 das beste Ergebnis darstellte.

Im Zuge dieser Beurteilung konnten die Experten 72 Kandidaten erkennen, die, quer durch die verschiedenen Weinsorten, als „Fünf Sterne Wein“ in Frage kommen. Darunter fielen Rotweine, Weißweine, Dessertweine botrytise, natürliche Süßweine, Portweine und methode cap classique Perlweine. Wie zuvor wurden nur fertig abgefüllte Weine, die während der Zeitdauer bei der Erstellung des Weinführers verfügbar waren, betrachtet. Die in Frage kommenden Weine wurden dann durch das ganze Gremium beurteilt. Andrew McDowall, der Herausgeber des Weinführers, sagt: „Unsere Strategie bleibt verkosten und beurteilen und soweit es praktisch möglich ist, sind alle Weine, die während dem Zeitraum von der besonderen Ausgabe verfügbar sind, lokale als auch auswärtige. Angesichts der enormen Anzahl von Angeboten und den einzelnen Sorten die getestet wurden, stellen die Weine welche „Fünf Sterne“ verdienen in der Tat eine exklusive Gruppe dar.“

“Chelsea Flower Show” - Kirstenbosch wins Gold

Kirstenbosch wins gold at Chelsea Flower Show

The much-needed early rainfalls in the Western Cape have sowed the seeds for what many are predicting will be a bumper flower season. This is appropriate following on South Africa's success at the 2005 Chelsea Flower Show in London, where the Kirstenbosch display picked up their 27th gold medal. Regular medal winners at the show, its almost become expected for SA to win gold, after all, we come from the Cape Floral Region, one of only seven World Heritage Sites in the country. The Kirstenbosch exhibit entitled 'African Dream' featured some of the finest and most beautiful indigenous flora - a fitting tribute to one of the world's six floral kingdoms. In the words of exhibit designer David Davidson: "This was the 30th consecutive year South Africa has been exhibiting at Chelsea . It feels great to top that achievement with our 27th gold medal." To Davidson's delight, a suitably impressed Princess Anne pulled him aside for a conversation about the award-winning stand.

Add to that a whole range of flower shows all over the Western Cape and you'll discover why the upcoming months are a nature lover's dream.

Kirstenbosch gewinnt Gold auf der “Chelsea Flower Show”

Die dringend benötigten frühen Regenfälle im Western Cape haben viele dazu veranlasst, eine großartige Blumensaison vorherzusagen. Dass dies nicht zu hoch gegriffen scheint, zeigt Südafrikas Erfolg bei der Chelsea Flower Show 2005 in London, bei der Kirstenbosch die 27. Goldmedaille abgeräumt hat. Südafrika gewinnt regelmäßig eine Medaille und es wird schon fast erwartet, dass Südafrika Gold gewinnt.

Das Kirstenbosch-Ausstellungsstück, das den Titel 'African Dream' trägt, zeigte einige der schönsten einheimischen Blumen. – Ein angemessenes Tribut für eines der sechs „Blumenkönigreiche“ der Welt. David Davidson, der Ausstellungsdesigner sagte: „Dies ist das 30. Jahr in Folge, in dem Südafrika bei der Ausstellung dabei ist. Es ist großartig, dass dies mit unserer 27. Goldmedaille belohnt wird.“ Davidson freute es auch, dass Prinzessin Anne, die sichtlich beeindruckt von dem Ausstellungsstück war,  ihn zu einem kleinen Gespräch gebeten hatte.

The South African Airways Cape Town Flower Show 2005, will celebrate its third year with a move to the spectacular new outdoor setting of Lourensford Wine Estate at the foot of the Helderberg Mountain in Somerset West. It will again provide visitors with an opportunity to experience the splendor of South Africa's rich floral heritage.
